Driving after consuming CBD: what does the law say?
In France, cannabidiol (CBD) is available over the counter, as long as it has a residual concentration of THC (less than 0.3%). But can you drive safely after consuming CBD?
The answer comes to us from a decision of the Court of Cassation, rendered in the judgment of June 21, 2023. In essence, it is prohibited to get behind the wheel after having consumed CBD from the moment there are traces of THC, a substance classified as a narcotic.
In other words, the presence of THC, even minimal following the consumption of CBD, could lead to sanctions for driving under the influence of narcotics. Two risk factors should be considered:
Even if you are strictly legal, the fact of massively consuming CBD with less than 0.3% THC can cause the accumulation of the illicit substance in your body;
We are not all equal when it comes to THC. While some eliminate it fairly quickly (within a few hours), others can retain traces of the molecule for several days.
CBD while driving: what effects on driving?
Depending on the concentration of the product, CBD will have more or less soothing and more or less sedative effects on the body. This is why cannabidiol and other non-psychotropic cannabinoids are indicated to fight against insomnia, stress and anxiety.
A note from the French association of addictovigilance centers estimates that CBD can cause a state of drowsiness in certain drivers, particularly if they are already tired and if they lack energy. sleep. Vigilance is therefore required.
⚠️ Caution:Adulterate or fraudulent CBD products contain more THC than the law allows. Also, full-spectrum hemp products can increase THC levels in saliva and blood if consumed massively.
CBD and roadside checks: what you need to know
If CBD has been perfectly legal in France since the end of 2020, a gray area persists when it comes to driving “under the influence”. Several CBD consumers say they have undergone saliva tests, showing a positive result for THC. What to do in this situation? Our advice:
Keep proof of purchase of your CBD product (invoices, receipts);
NEVER transport unpackaged hemp, especially in quantities that may appear “commercial”;
If you are stopped by the police, remain calm and cooperate with the officers;
If you know you are going to drive, plan your consumption accordingly: no CBD and especially no full-spectrum CBD a few hours before the road;
Alcohol accentuates the calming effect of CBD, reaching the level of sedation and drowsiness.
Your safety and that of your passengers should ALWAYS be your priority. If you are unsure of your ability to drive after consuming CBD, use another means of transportation.
