Growing your cannabis in Luxembourg: what does the law say?
Since July 21, 2023, Luxembourgers have been authorized to cultivate cannabis at home, subject to compliance with the following conditions:
- Legal age: only adults 18 years and older are allowed to cultivate cannabis;
- Limitation on the number of plants: a maximum of four cannabis plants can be cultivated per household (not per person);
- Source of plants: cannabis plants must be grown from seeds or authorized seeds, Cannabis Indica or Cannabis L. Sativa strain. ;
- Growing can be done both indoors and outdoors, provided that the plants are not visible from public spaces;
- Outdoor cannabis cultivation is restricted to areas immediately adjacent to the home. It is therefore permitted to cultivate cannabis in your own garden, provided that it is not exposed to public view.
Luxembourg legislation formally prohibits the cultivation and consumption of cannabis in public spaces or in the presence of minors. Failure to comply with these rules can result in severe fines of up to 250,000 euros.
Why was such a law adopted by the Luxembourg government?
During an intervention on RTL Today, Luxembourg MP Josée Lorsché clarified the objectives of the new legislation on cannabis. She stated in particular that it mainly aimed to “fight against drug-related crime and the sale of cannabis on the black market”. She insists that the intention is not to trivialize or promote the use of cannabis in the Grand Duchy.
For his part, Justice Minister Sam Tanson criticized the traditional repressive approach to drugs, calling it an “absolute failure.” According to him, it was imperative to adopt a new direction and develop innovative solutions.
Remember that Luxembourg is the second country in the European Union to have legalized recreational cannabis in 2021, after Malta.
Buying seeds in Luxembourg: the rules to follow?
In Luxembourg, residents can now cultivate cannabis at home by ordering seeds online, including imports, while awaiting the development of a local production and marketing sector.
Imported seeds must, however, comply with certain strict rules : in accordance with a European directive, the seed label must include the name of the producer, the number of seeds and a health warning. They must also come from the usual strains, namely Indica or L. Sativa. Products must be 100% traceable.
Countries like the Netherlands, Spain and Austria have already implemented regulations for cannabis consumption and even offer “management models”. Moreover, many websites that comply with European Union standards offer seeds for sale, which facilitates legal and regulated access for Luxembourg consumers.
